Can I rent out my home?

Whether you can rent out your home depends on the type of agreement you have with us. Here’s what you need to know:

Social housing tenants

You cannot rent out your whole home. Subletting is not allowed under your tenancy agreement and is a criminal offence. You could be prosecuted for tenancy fraud. Whilst you can be prosecuted for tenancy fraud, you could also receive a custodial sentence and may have to pay legal costs and/or give back any money you made from subletting.

What is an unlawful profit order?


Subletting your home also deprives other families of affordable housing. If you need to move, please talk to us, we may be able to help.

Even though you can't sublet your home, you may be able to take in a lodger.

Leaseholders

You can rent out your home as long as your lease doesn’t prohibit it. If your lease says you can’t sublet, then you cannot rent it out. If you do let your home, please email [email protected] with your new address.

As the leaseholder, you are responsible for making sure your tenants follow the terms of your lease.

Shared owners

If you’re a shared owner, you cannot rent out your home. This is not allowed under the government’s shared ownership scheme. However, you may be able to take in a lodger.

Private rent tenants

You cannot rent out your whole home. This is not allowed under your tenancy agreement. Illegal subletting is a criminal offence, and you could be prosecuted.
